E-Bike Waiver

This E-Bike Rental Waiver ("Waiver") is a legally binding agreement between the undersigned ("Renter") and Vulpine Property Services T/A Vulpine Bikes with registration number 14911583 ("Company") for the rental of an electric bicycle or bicycles ("E-Bike"). By signing this Waiver, the Renter acknowledges and agrees to the following terms and conditions:

1. Agreement and Definitions

This Waiver is made and entered into by and between the Company and the Renter. "E-Bike" refers to the electric bicycle and any related equipment rented from the Company.

2. Acknowledgment of Risks

The Renter understands and acknowledges that riding an E-Bike involves inherent risks, including but not limited to accidents, injuries, and damages to property. The Renter accepts and assumes all risks associated with the use of the E-Bike.

3. Assumption of Risks

The Renter voluntarily assumes all risks associated with the use of the E-Bike, whether known or unknown, including but not limited to those listed above.

4. Compliance with Highway Code and Traffic Laws

The Renter agrees to comply with all applicable traffic laws, the Highway Code, and regulations while operating the E-Bike. The Renter shall ride in a safe and responsible manner, respecting all traffic signals, signs, and pedestrian rights of way. The Renter acknowledges that they have read and understand the Highway Code.

5. Minimum Age Requirement

The Renter certifies that they are at least 14 years old, which is the minimum age requirement for renting and operating the E-Bike. Renters aged 14 or 15 years old must be accompanied by a parent or guardian.

6. Acknowledgment of Receipt of E-Bike and Equipment

The Renter acknowledges that they have received the E-Bike with all necessary equipment, including but not limited to a helmet, reflectors, and lock.

7. Acknowledgment of Return Timeframe and Fees

The Renter acknowledges that the E-Bike must be returned within the allotted time frame as agreed upon at the time of rental. Late returns will incur additional fees which shall be charged at 50% of the rental cost for the first hour and thereafter the full daily fee.

8. Mandatory Use of Safety Equipment

The Renter agrees that the use of safety equipment, including but not limited to a helmet and reflectors, is mandatory while operating the E-Bike.

9. Prohibition of Use Under the Influence

The Renter certifies that they will not operate the E-Bike under the influence of alcohol or drugs.

10. Care and Storage of E-Bike and Equipment

The Renter agrees to treat the E-Bike and equipment with respect and care. The Renter will store the E-Bike, locked to a permanent fixture, including both the wheel and frame, in a covered, secure place out of sight when not in use.

11. Liability for Damage

If the Renter purposely causes damage to the E-Bike or equipment, other than general wear and tear, the Renter will be liable for the damages and the Company is entitled to charge an extra payment for compensation.

12. Notification of Accidents, Theft, or Damage

The Renter agrees to promptly notify the Company in the event of any accident, theft, or damage involving the E-Bike.

13. Exclusive Use by Renter

The Renter agrees not to allow anyone else to use the E-Bike during the rental period.

14. Child Trailer Use (if applicable)

If the E-Bike includes a child trailer, the Renter acknowledges that the trailer weight limit is 34kg (child + cargo) and it is for the use of children aged between 1 year and 7 years.

15. Adherence to Instructions

The Renter agrees to adhere to any verbal or written instructions regarding the E-Bike (and trailer) provided by the Company before use.

16. Permitted Area of Use

The Renter acknowledges that the use of the E-Bike is only permitted within the permitted area defined by the Company and not outside that area.

17. Additional Charges for Collection

If the E-Bike runs out of battery or fails to operate and cannot be returned to a collection/delivery point, the Renter may be charged an additional amount to arrange for collection.

18. Proof of Identification

The Renter must provide proof of identification, including two forms of ID (e.g., driving license, passport) and proof of address (utility bill or similar, which can be presented on a mobile device).

19. No Refunds for Early Return

No refunds or reductions will be given for the early return of an E-bike or any equipment.

20. Right to Refuse Rental

The Company reserves the right to refuse hire of any E-bike or any equipment.

21. Pre-Cycle Hire Briefing

An E-bike or any equipment will only be hired to customers who attend a pre-cycle hire briefing at the time of collection. If for any reason the Company believes a customer is not competent to operate an E-bike or any equipment (to be decided in Company's absolute discretion), it reserves the right to refuse hire.

22. Equipment Booking and Cancellation Policy

All equipment booked and paid for in advance shall be made available for delivery and collection at the pre-arranged times and location as specified at the time of booking. In the event that delivery or collection is not possible due to unforeseen circumstances, the Company shall provide a full refund. The Renter must provide a minimum of 24 hours' notice for the cancellation of an advance booking. Failure to provide the required notice will result in the full payment being charged.

23. Waiver and Release of Liability

To the fullest extent permitted by law, the Renter hereby waives, releases, and discharges the Company, its officers, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, or expenses arising from or in connection with the use of the E-Bike, whether caused by the negligence of the Company or otherwise.

24. Indemnification

The Renter agrees to indemnify, defend, and hold harmless the Company, its officers, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, or expenses (including legal fees) arising from or related to the Renter's use of the E-Bike, including but not limited to any claims brought by third parties.

25. Condition and Care of the E-Bike

The Renter acknowledges that they have inspected the E-Bike and found it to be in good working condition. The Renter agrees to return the E-Bike in the same condition as it was rented, normal wear and tear excepted. The Renter shall not modify or tamper with the E-Bike in any way.

26. Insurance

The Renter understands that the Company does not provide insurance coverage for the Renter or the E-Bike. The Renter is responsible for obtaining any personal insurance coverage they deem necessary.

27. Medical Fitness

The Renter certifies that they are in good health and have no medical conditions that would impair their ability to safely operate the E-Bike. The Renter acknowledges that they have not consumed alcohol or any drugs that could impair their ability to ride the E-Bike safely.

28. Governing Law

This Waiver shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from or in connection with this Waiver shall be subject to the exclusive jurisdiction of the courts of England and Wales.

29. Severability

If any provision of this Waiver is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be deemed modified to the extent necessary to make it valid and enforceable.

30. Entire Agreement

This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior or contemporaneous understandings or agreements, whether written or oral.

31. Acknowledgment of Understanding

By completing the form below, the Renter acknowledges that they have read, understood, and agree to the terms and conditions of this E-Bike Rental Waiver. They acknowledge that they are signing this Agreement freely and voluntarily and intend by their signature to be a complete and unconditional release of all liability to the greatest extent allowed by law.
